A lawsuit for a “wrongful death” is a civil lawsuit filed by the personal representative of a deceased person to recover for certain losses sustained by the surviving spouse and next of kin of the deceased person. It is governed by the Illinois Wrongful Death Act, 740 ILCS 180/0.01 et seq. Under the Act, a jury may give such damages as they deem fair and just compensation relating to things such as loss of financial support; loss of the benefits that the family would have received from the deceased’s continued existence – such as love, affection, care, attention, companionship, comfort, guidance and protection; or a child’s loss of instruction and training due to the death of a parent.
